Long-term Care Facilities: Streamlined appeals
AB 641– Chapter 729 - H&S Code §§1423, 1424, 1424.5, 1428, 1428.2, 1429; W&I Code §14015.12

Summary: Eliminates the citation review conference process from citation appeals process for long-term care facilities to streamline oversight protection for residents.
Background: The citation appeals process for long-term care facilities precedes the normal administration appeals procedures and was designed to cut out the need for the regular administrative appeals. However, this intermediate step sometimes takes 8 years to complete which makes citations virtually useless. Also under the previous law, when the state agency secures a monetary penalty against a long term care facility for violating state law, it is prohibited from recommending to a federal agency that a penalty be issued against this facility for its violation of federal law.
The New Law: Eliminates the citation review conference process from the citation appeals process for long term care facilities. Also removes prohibition against state agencies making certain penalty recommendations to federal agencies.
