SWEEPSTAKES COMPANIES – STATEMENTS MUST BE TRUTHFUL
SB 1400, Business & Professions Code 17539.15
This new law prohibits sweepstakes companies from making the following claims, unless they are true:
- A person has been specially selected,
- The person receiving the solicitation has received special treatment,
- The person is being notified a second or final time of the opportunity to receive or compete for a prize, or
- A document is authorized, issued, or approved by an official body.
This law also requires sweepstakes offers to disclose the date the final winner will be determined, and prohibits sweepstakes sponsors from charging a fee as a condition to obtain a cash prize or information about a prize.
