Damages: Individuals Can Get Up To $7,500
Civil Code of Procedure Section 116.221. 116.610
Many existing laws limit the amount of damages a small claims judge can award to the old limit of $5,000.
This law raises the limit of damages to $7,500 for individual consumers. This new limit for damages applies to residential security deposits, condominium associations, class actions, claims against public utilities, and damages to property caused by a minor. The new limit also applies to cases involving illegal discrimination based on race, religion, rights of access for the disabled and civil rights actions.
