Vacating Judgments And
Correcting Clerical Errors

(Code of Civil Procedure 116.725)

This new law lets parties file only one motion to vacate a judgment or correct a clerical error. The motion must be filed within 30 calendar days after the clerk mails the notice of entry of judgment.

The law used to require a 10-day wait after an appeal was concluded before the case would be sent back to the Small Claims Court to enforce the judgment. The new law no longer requires the 10-day waiting period.
