Payment Of Filing Fees
And Bounced Checks:
Party must pay in full before the Court will schedule a hearing (Civil Court of Procedure 411.20)
The old law required the Court to accept the lawsuit and schedule a hearing, even if only a portion of the filing was paid or the check for the filing fee bounced.
This new law requires that the filing fee be paid in full before the Court would schedule a hearing. If the filing fee is not paid in full, or the check to pay for it bounces, the Court will charge an additional $25 administrative fee, which would have to be paid before the Court will schedule a hearing.
